Applicable Law and Jurisdiction
Applicable Law: The legal relationship between you and The Occasionist is subject to Swiss law exclusively.
Jurisdiction: For any claims against The Occasionist, the exclusive jurisdiction is Zurich. We reserve the right to initiate legal proceedings against the consumer either at their place of residence or in Zurich.
If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable, such provision will be modified or interpreted to the extent necessary to make it valid, legal, and enforceable. The invalidity or unenforceability of any provision will not affect the validity or enforceability of the remaining provisions.
Limitation of Liability
The Occasionist acts as an intermediary between clients and travel service providers. As such, we cannot guarantee the availability, accuracy, or quality of third-party services, nor can we eliminate the risks associated with travel.
In no event shall The Occasionist be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of our services, including but not limited to, loss of data, loss of profits, loss of enjoyment, costs, property damage, theft, personal loss, injury, or death.
You acknowledge and agree that any travel bookings, activities, or services arranged through The Occasionist are at your own risk. We shall not be held responsible for any acts, errors, omissions, or negligence of any third-party suppliers, including but not limited to airlines, hotels, tour operators, or other participants.
It is your responsibility to obtain and maintain appropriate travel insurance to protect against any unforeseen circumstances or events that may arise during your trip, including property damage, theft, personal loss, injury, illness, or death. We highly recommend reviewing and understanding the terms and coverage of your travel insurance policy.
The Occasionist shall not be held liable for any damages, losses, delays, cancellations, or inconveniences caused by traffic, weather, animals, civil unrest, natural disasters, political instability, force majeure, or any other event inherent to travel experiences.
In the event that The Occasionist is found liable for any claims or damages, our liability shall be limited to the total minimum amount permitted by law.
Please carefully read and understand the terms and conditions provided herein. By using our services, you acknowledge and accept the limitations of liability outlined above and agree to hold The Occasionist and its employees, shareholders, officers, directors, successors, and agents harmless from any claims, actions, or liabilities arising from your use of our services.
The Occasionist will provide you with information regarding any known health requirements for your chosen destination(s). It is your responsibility to obtain and fulfill any necessary health requirements that we have informed you of, such as vaccinations or medical certificates. We cannot be held accountable for any issues or disruptions arising from non-compliance with health regulations. We can communicate with your healthcare professional, upon your consent, to inform them of your destination(s) and facilitate a comprehensive consultation regarding your health and travel needs.
It is the responsibility of the traveler to ensure they possess a valid passport with a minimum validity of at least six months beyond the planned departure date. We kindly request that you provide a copy of your passport to enable us to book your flights. Additionally, we advise you to thoroughly review any travel documents provided by The Occasionist as part of the booking process (i.e. plane tickets). Any errors or omissions may lead to significant travel disruptions or denial of boarding for which The Occasionist cannot be held responsible.
If your trip involves a destination that requires you to obtain a visa before you travel, our team will take care of the application on your behalf. We will collect the necessary information from you in advance. Throughout the process, we will provide updates and guidance to ensure a smooth visa issuance. It is the travelers responsibility to ensure that all information provided to us is accurate and to check any documents we provide for oversight or discrepancies. Any errors or omissions may lead to significant travel disruptions or denial of your entry into the country of your destination for which The Occasionist cannot be held responsible.
While travel insurance is not mandatory for booking a trip with The Occasionist, we highly recommend obtaining travel insurance to protect yourself and your investment. Travel insurance provides coverage for various unexpected events such as trip cancellations, medical emergencies, lost luggage, and other unforeseen circumstances that may disrupt your travel plans. Having travel insurance offers you peace of mind and financial protection during your journey. We advise you to carefully review different insurance options and select a policy that suits your specific needs. If you have any questions or need assistance in finding suitable travel insurance, our team will be happy to provide recommendations and guidance.
Cancellations & Changes
Please note that flight bookings and deposits are typically non-refundable. However, in the event of a cancellation, we will make every effort to retain your deposits as travel credit with The Occasionist. This travel credit can be applied towards rebooking your trip at a later date.
Please note that any requests to shift travel dates or postpone your trip are subject to availability. While we will make every effort to accommodate your new dates, in some cases, it may be treated as a cancellation and rebooking. Our team will work closely with you to find the best possible solution and make the necessary arrangements.
We accept major credit cards, such as Visa, Mastercard, and American Express, as well as bank transfers and major cryptocurrencies. Please note that different fees may apply depending on the chosen mode of payment.
The Occasionist provides quotations for trip packages and services upon request. These quotations include all costs relating to our planning, handling, and operational services and are based on current currency exchange rates and taxes. They are provided for informational purposes only and are subject to change without prior notice until the booking is confirmed. Once you have confirmed that you would like to proceed with the booking, we will send you a reservation request with the expected final price. We strive to ensure the accuracy of the reservation request, but we cannot guarantee the availability of the quoted prices or the services mentioned therein until the booking is confirmed.
To confirm your booking, full payment is required for flight bookings to secure your seat. As for the trip package itself, we require a deposit of 50% of the total trip cost within 10 days after receiving the reservation request to finalize the booking. The remaining balance is due 90 days prior to the start date of your trip.
Privacy and Data Protection
All intellectual property rights related to the content, design, and functionality of The Occasionist website and its associated materials are owned or licensed by The Occasionist GmbH. These intellectual property rights include, but are not limited to, trademarks, logos, trade names, service marks, copyrighted materials, and proprietary information.
We reserve all rights not expressly granted in these terms of service, and any unauthorized use of our intellectual property is strictly prohibited.
The Occasionist offers a range of travel services, specializing in the planning, organization, mediation, and execution of trips, events, and experiences worldwide. Our services encompass the selection, booking, and/or provision of accommodations, transportation, activities, and related services, as well as the mediation and sale of associated products.
